KIRBY SANITATION

RESIDENTIAL AND RECYCLING TERMS AND CONDITIONS

 

1. PHYSICAL CONDITION OF RENTAL ITEM (S)

You acknowledge that prior to taking the rented item(s), you examined it, saw it in operation (if appropriate), and are aware of its condition and that it is in good condition. It is your responsibility to return the rented item(s) to Kirby Sanitation in the same condition, except for ordinary wear and tear.

 

2. RESPONSIBILITY FOR EQUIPMENT

From the time the item(s) is in your possession until it is returned, you are responsible for it. If the item(s) is lost, stolen or damaged due to personal neglect while rented, you shall be responsible for all charges, including labor costs, to replace or repair the item(s).† Do not put anything hot into your trash cart; the plastic will melt.† Do not over load your cart (250 lb. maximum) as this will result in damage to cart. However if your cart fails or breaks due to normal wear and tear there is no charge.† You are supplied with a clean trash cart and it is your responsibility to maintain its cleanliness.† Please return your cart in the same condition you received it.

 

3. USE OF THE ITEM (S) / CONDITIONS (RESIDENTIAL TRASH COLLECTION)

Trucks start running routes as early as 4 a.m.† It is your responsibility to put your trash out by the road on the day it is to be collected or the night before to insure service.† Kirby Sanitation bases its prices on the amount of waste that will fit into a 96-gallon trash cart; we will however pickup any extra garbage that is placed out for collection and additional charges will be applied to your next billing.† If you have additional trash on a regular basis and would like to have it picked up please call the office to make arrangements to receive an additional cart(s).† Please do not put oil, paint, tires, batteries, propane tanks, pressurized tanks, or hazardous material in your cart for collection due to the fact these items are not accepted at the landfill.† You further agree that the item(s) will be used only at the address designated and only for the purpose for which the item(s) was manufactured and intended. Subleasing or improper use is prohibited.

 

4. USE OF THE ITEM (S) / CONDITIONS (RECYCLING COLLECTION)

Trucks start running routes as early as 5 a.m.† It is your responsibility to put your recycling out by the road on the day it is to be collected or the night before to insure service.† Kirby Sanitation will be implementing a single stream recycling system, which means you do not have to sort your recycling into separate containers.† Just place all acceptable items in your bin(s) and set it our by the Road for collection.† Your recycling collection day will be on the 2nd and 4th Friday each month!!† We will be recycling #1 and #2 plastic, paper, cardboard, and aluminum.† All containers are to be rinsed and drained before they are put out for collection.† If additional recycling bins are need they will be supplied at no additional charge.†

 

5.† EXTRA SERVICES

Kirby Sanitation offers yard waste collection to our customers.† Yard waste can be paid for two ways.† 1) Prepaid with yard waste stickers.† Stickers are $1.00 each and can be placed on yard waste bags or bundles.† 2) Yard waste charges can be added to your next billing.† If yard waste is put out for collection and does not have prepaid stickers on the bags or bundles. Then the charges will be added to your next bill.† The rate for both types of payment is $1.00 per bag or bundle.† Please call the office to purchase your yard waste stickers and let us know if you have an excessive amount of yard waste (5 or more bags) so we can schedule to have it picked up in case there is not sufficient capacity to pick it up on route.† All yard waste must be securely bagged and limbs must be bundled.† Limbs must be cut into 18-inch lengths and have 2-inch or smaller diameter.† Bundles must not exceed 35 pounds.† Kirby Sanitation is not responsible for busted bags or the mess they make, so please do not over load your yard waste bags.† Kirby Sanitation also offers large item collection to its customers (washers, dryers, couches, etc.) however this cannot be done on route and requires a special trip to be picked up, so please call the office if you need to schedule a pickup.† The minimum charge for any large item collection in $50.00

 

6. CHARGES AND PAYMENTS

You are responsible for charges from the time service is started until it is cancelled, and other charges hereunder.† All invoices are due upon receipt. We accept cash, checks, money orders, credit card and debit card.† Statements are mailed to accounts not paid 30 and 60 days after invoice date.† Service will be suspended after accounts are 90 days past due and a $10.00 late fee added to the account.

 

7. COLLECTION COSTS

All invoices are due upon receipt; statements are also mailed to all account not paid 30 and 60 days after invoice date.† Service will be suspended after accounts are 90 days past due and a $10.00 late charge added to the account.† The returned check charge is $25.00, and cash, certified check, or credit card can then only pay the account balance.† You agree to pay attorney fees, collection fees, court costs and any other expenses incurred in collecting any charges under this agreement, in retaking the rented item(s) or otherwise in enforcing the terms of this contract.

 

8. HOLIDAYS

Scheduled Holidays are: New Years Day, M.L. King Day, Memorial Day, 4th of July, Labor Day, Thanksgiving Day and Christmas Day.† If your pick up day falls on a holiday, your service will be one day late and all service days thereafter will be one day late for that week.† If the Holiday Falls on Saturday or Sunday, service will not be affected.

 

9. HOLIDAY EMAIL LIST

Kirby Sanitation Holiday Email List is a notification program designed to remind our customers of upcoming holidays and our collection schedule for the week of the holiday.† This system will also be used to notify customers of any other delay in our collection schedule such as weather delays.† Your email address will be kept confidential and not shared or sold to anyone outside of Kirby Sanitation.

 

9. RETURN OF ITEM (S)

Any equipment supplied to you is property of Kirby Sanitation and is rented to you subject to rental/service charges. If you fail to return the item(s) supplied to you after cancellation of service or termination of service due to lack of payment, Kirby Sanitation can enforce its property ownership of the item(s) and, to protect its interest under this contract, may retake the item(s) at any time and to do so Kirby Sanitation or its representatives may enter your property and you hereby waive any right of action against Kirby Sanitation for such entry and retaking.† The sale or concealment of rented item(s) is prohibited, and such action may constitute a crime. Kirby Sanitation, in addition to any other action we may take, may notify the authorities and take other action, including the filing of criminal complaints, subjecting you to prosecution.

 

10. E-BILLING

Kirby Sanitation E-Billing is our new paperless billing system.† By signing up for E-Billing, you will no longer receive a paper bill in the mail.† Instead you will be emailed your bill at the beginning of your billing cycle.† You will still have your choice of payment options.† If you sign up for Kirby Sanitations E-Billing, you will automatically be enrolled in the Holiday Email List.† It will be the customerís responsibility to notify Kirby Sanitation of any changes of email address or cancellation of E-Billing

 

11. AUTO-PAY

By singing up for Kirby Sanitation Auto-Pay you give Kirby Sanitation the right to electronically store your credit or debit card information and automatically charge it at the beginning of you billing quarter.† Charges will be processed on the 1st day of the first month of your billing cycle (quarter) for the services provided during that billing cycle.† This new billing system is compliant with the PCI Data Security Standards.† However in the event of a security breach you agree to hold Kirby Sanitation irreproachable and free of any liability.
